This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.
Your Rights
When it comes to your health information, you have certain rights. You have the right to:
- Get an electronic or paper copy of your medical record: Usually provided within 30 days. We may charge a reasonable, cost-based fee.
- Ask us to correct your medical record: You can ask us to correct information you think is incorrect or incomplete. We may say “no,” but we’ll tell you why in writing within 60 days.
- Request confidential communications: Ask us to contact you in a specific way (cell phone, work phone, etc.) or send mail to a different address.
- Ask us to limit what we use or share: You can ask us not to share certain information for treatment or operations. (Note: If you pay for a service out-of-pocket in full, we will honor your request not to share that info with your insurer).
- Get a list of those with whom we’ve shared information: You can ask for a list (accounting) of disclosures for six years prior to your request date.
- Get a copy of this privacy notice: At any time, even if you agreed to receive it electronically.
- Choose someone to act for you: If you have a medical power of attorney or legal guardian, they can exercise your rights.
- File a complaint: If you feel we have violated your rights, contact us at the address below. We will not retaliate against you.
Your Choices
For certain health information, you can tell us your choices about what we share. If you have a preference, talk to us.
- You have the right and choice to tell us to: Share information with your family or friends involved in your care, or share information in a disaster relief situation.
- We never share your information for these purposes unless you give us written permission: Marketing purposes or the sale of your information.
- Fundraising: We do not currently engage in fundraising. If we do, we will provide you an easy way to opt-out.
Our Uses and Disclosures
How do we typically use or share your health information?
- Treat You: We use your information to provide care and can share it with other professionals treating you (e.g., a specialist or your primary care physician).
- Run Our Organization: We use your information to manage our practice, improve your care, and contact you when necessary.
- Bill for Your Services: We use and share your information to bill and get payment from health plans or other entities.
- Return to Duty / Occupational Health: Specifically for ReturnToDutyNow.com services, we may share information with your employer or a third-party administrator only as permitted by law or with your specific authorization regarding your fitness for duty and work status.
Special Note on Substance Use Records: If you are receiving services related to substance use disorder evaluation or treatment (such as SAP services), your records are also protected under federal law 42 CFR Part 2. How else can we share your information?
We are allowed or required to share your information in ways that contribute to the public good, such as:
- Public Health and Safety: Preventing disease, reporting adverse reactions, or reporting suspected abuse/neglect.
- Comply with the Law: Sharing with the Department of Health and Human Services to ensure we are complying with federal privacy law.
- Workers’ Compensation: We share information for workers’ compensation claims or similar programs established by law.
- Law Enforcement & Lawsuits: Responding to a court order, subpoena, or law enforcement official.
Our Responsibilities
- We are required by law to maintain the privacy and security of your protected health information.
- We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information.
- We must follow the duties and privacy practices described in this notice.
- Substance Use Records: To the extent we have records subject to 42 CFR Part 2, we will not share that information for legal proceedings against you without your written consent or a specific court order/subpoena.
